COMPETITION REGULATIONS

"Create a promotional slogan for LORRIES trailers"

§1. Definitions

The terms used in these regulations (hereinafter referred to as the "Regulations") mean: 

  1. "COMPETITION" - competition entitled "Create a promotional slogan for LORRIES brand trailers", run on the terms set out in these Regulations. 
  2. "ORGANIZER" - owner of the LORRIES brand, STALKO Sp. z o. o. sp.k., 00-403 Warszawa, ul. Solec 24/253, NIP number 9481990793, REGON number 141434663. 
  3. "PARTICIPANT" - an adult natural person with full legal capacity who voluntarily declares his/her participation in the Competition. 
  4. "COMPETITION COUPON" – application form for the Competition. 
  5. "COMMITTEE" – Competition Commission consisting of representatives of the Organizer.

§2. General provisions

  1. These Regulations define the rules and conditions of participation in the Competition. 
  2. The competition is held in the territory of the Republic of Poland, during the fair event "Poland Boat Show - Warsaw Yacht Salon" organized on November 3-6, 2022. in Nadarzyn, Aleja Katowicka 62, 05-830 Nadarzyn (hereinafter referred to as: "Fair"). 
  3. The competition starts with the opening of the Fair on November 3, 2022. at. 10:00 and ends on November 6, 2022. at. 17:00. Applications for the Competition are accepted during the Fair. 
  4. The competition is not a game of chance, a raffle, a mutual bet, a promotional lottery, the result of which depends on chance, or any other form of a game of chance provided for in the Gambling Act of November 19, 2009 (Journal of Laws 2009, No. 201, item 1540, as amended). 

§3. Conditions of participation in the competition

  1. Any adult natural person with full legal capacity may participate in the competition, excluding the persons referred to in section 2 below. 
  2. Employees of the Organizer and members of their immediate families are excluded from participating in the Competition. Members of the immediate family include ascendants, descendants, siblings, spouses, parents of spouses, persons in cohabitation and persons in adoption, as well as the parents of these persons. 
  3. Before taking part in the Competition, the Participant should read the Regulations. 
  4. The Contest Coupon must contain a legible signature of the Participant confirming that he or she has read these Regulations, consent to the processing of his or her personal data in order to determine the true identity of the Participant and issue the prize, and the obligation to transfer the copyright to the submitted competition works (promotional slogans). 
  5. Competition coupons are free of charge and are available at the Organizer's stand on the date specified in § 2 section 3 above. 
  6. Applications for the Competition, understood as submitting a completely completed Competition Coupon, are accepted at the Fair at the Organizer's stand. 
  7. Participation in the Competition, as well as the rights and obligations related thereto, including the right to demand the award of a prize, cannot be transferred to other persons.
  8. The organizer is not responsible for the inability to submit a competition entry for reasons beyond his control.

§4. Competition's rules

  1. The Competition Participant must complete the Competition Coupon completely, enter his/her own promotional slogan and contact details in order to establish the Participant's identity. 
  2. One Participant may complete a maximum of 3 (three) Competition Coupons, and only one prize may be awarded to one Participant. 
  3. The competition is a one-stage competition.
  4. Slogans containing illegal content, violating social and moral norms or being inconsistent with the assumptions of the Competition (promotion of LORRIES brand trailers) will not be taken into account, i.e. they will not be subject to the Commission's assessment. 
  5. The Competition Participant declares that the entries submitted in the Competition constitute a manifestation of his/her own creative activity and do not violate any rights of third parties, including their personal rights. In the event that the entry violates any rights of third parties, including proprietary and personal copyrights, the Participant will undertake to satisfy any claims submitted by third parties in connection with the violation of these rights, with the exception of the obligations and responsibilities incumbent on the Organizer in this respect, arising from from applicable legal provisions. 

§5. Awards

  1. Three winners will be selected in the Competition.
  2. The main prize in the competition is the "RAVE" bio-fireplace worth PLN 190 (one hundred and ninety PLN) gross. The two remaining Prizes are a set of LORRIES corporate gifts worth PLN 150 (one hundred and fifty PLN) gross each. 
  3. Winners are not entitled to request that the Prize be exchanged for another one or for a cash equivalent. 
  4. The winner of the main prize will receive the Prize by personal collection from the Organizer's office on a previously agreed date, after providing the necessary information, in accordance with the principles referred to in §7 below, or by courier at the Organizer's expense, after providing the necessary address information. The remaining winners will receive the prizes via courier at the Organizer's expense, after providing the necessary address information. In the event of an incorrect address or data of the Competition Participant preventing effective delivery of the prize, as well as in the event of failure to claim the main prize within 30 days from the date of the Competition results, despite correct notification of the prize, the right to the prize expires.

§6. Competition results

  1. After the end of the Competition, on November 10, 2022. at. 12:00, the Committee consisting of representatives of the Organizer will select three winners ("Winner") among the Participants, whose entries will be rated highest by the Competition Committee. When assessing the competition slogans, the Competition Committee will take into account the creativity of the Participants, i.e. the author of the most interesting promotional slogan will be awarded. 
  2. The winners of the competition will be notified by phone and, in addition, the list of winners will be announced on the company profile on the Facebook social networking site at www.facebook.com/Lorriesco. Participants agree to this form of notification. 
  3. The Organizer will arrange with the winner of the Main Prize the terms and date of receiving the Prize by telephone. 

§7. Personal data

  1. Pursuant to Art. 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council
    of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ EU L 119/1 of 4 May 2016) , hereinafter referred to as "GDPR", Stalko sp. z o. o. sp.k. declares that: 
    • The administrator of your data is Stalko sp. z o. o. sp.k., 00-403 Warszawa, ul. Solec 24/253, NIP number 9481990793, REGON number 141434663. 
    • The Administrator has appointed a Data Protection Inspector (DPO) to supervise the correctness of data processing. You can contact him at the following e-mail address: iod@lorries.pl 
    • Your personal data will be processed by the Administrator in connection with the implementation of the competition titled: "Come up with a promotional slogan for LORRIES trailers." Personal data are processed on the basis of consent, in accordance with Art. 6 letter a. GDPR. 
    • Personal data will be stored for the duration of the competition. 
    • Personal data provided by the Competition Participant will be processed for the purpose of organizing, promoting and conducting the Competition, publishing information about the Competition winners, as well as for archiving purposes and accountability required by the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council [1] on data protection personal data, hereinafter referred to as GDPR,
    • Stalko sp. z o. o. sp.k. you do not intend to transfer your data outside the European Economic Area.
    • You have the right to access your personal data and the right to rectify it, the right to request deletion, restriction of processing, and the right to object to data processing. 
    • Your personal data may be made available to other entities, including IT entities and entities authorized under the law. 
    • Access to your personal data may be provided to entities (processing entities) to which Stalko sp. z o. o. sp.k. orders the performance of activities that may involve the processing of personal data.
    • Persons whose personal data are processed by the Administrator have the right to: submit a complaint to the President of the Personal Data Protection Office (to the address of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw).
    • Providing personal data is voluntary, but necessary to enable the Administrator to organize the Competition and notify the winners about the award of prizes.
    • The Administrator does not process personal data of competition participants in a manner based solely on automated processing, including profiling.
  2. The processing of Participants' personal data will include the following scope of data: 
    • first name and last name,
    • e-mail adress, 
    • Phone number, 
  3. The Participant's data and e-mail address will be used only to conduct the Competition and issue prizes. 
  4. Refusal by the winner of the Competition to provide the data indicated in section 5 above may result in refusal to issue the Prize. 

§8. Violation of the Regulations

  1. Any violation of the Competition Regulations prevents the Participant from further participation in the Competition. The decision on this matter is made by the Organizer. 
  2. In particular, the following are considered violations of the Regulations: 
    • providing false or incorrect personal data; 
    • submitting a work to the Competition that violates §4 section 3 and 4 of the Regulations; 
    • an attempt to influence the course of the Competition contrary to the law - in particular through threats, fraud and extortion. 
  3. The decision to exclude from the Competition will be communicated to the excluded Participant via the means of contact provided by him/her. The Organizer's decision is binding and final. 

§9. Copyright

The regulations will be available on the website at: www.lorries.pl/konkurs

  1. By entering the competition, the Participant declares that he or she is the author and holds the copyright to the work he or she is entering in the competition and that it does not infringe the rights of third parties. 
  2. Submitting competition works is tantamount to the free transfer of all copyrights to the Organizer for the use of the submitted works or parts thereof in all fields of exploitation, i.e.: 
    • in the field of recording and reproducing the work - producing copies of the work using a specific technique, including printing, reprographic, magnetic recording and digital techniques; in the scope of trading the original or copies on which the work was recorded - placing on the market; 
    • in terms of disseminating the work in a manner other than that specified above - public performance, exhibition, display, reproduction, broadcasting and rebroadcasting, as well as making the work publicly available in such a way that everyone can have access to it at a place and time of their choosing. 
  3. The Author consents to the publication on the website, in social media and on other electronic and traditional media of the work submitted by the Organizer, as well as to the use of the work for the Organizer's promotional purposes. 
  4. Each time with the transfer of copyrights, without the need to submit any additional declarations, the Organizer is authorized to exercise the derivative copyright to the work that is the subject of the transfer, i.e. the right to authorize the disposal and use of the study, as well as to authorize third parties to exercise the derivative copyright. for such a song. The participant does not retain the right to exercise derivative copyright.
  5. The Competition Winner, pursuant to Art. 921 § 3 of the Civil Code, upon awarding the prize in the Competition, will transfer to the Organizer the proprietary rights to the works included in the competition works, in the fields of exploitation known on the date of transfer of rights, in particular those indicated in the preceding paragraph, and additionally in the scope of derivative rights . Determining the scope of the license indicated in section 2 shall apply accordingly to the transfer of rights.6. Persons submitting competition works authorize the Organizer to exercise on their behalf moral rights to the works recorded in the competition entry, in particular by deciding on the first dissemination of the work.7. The Organizer is obliged to respect the personal copyrights of the Competition Participants and to mark the authorship of the competition works when using them. 

§10. Final Provisionse

  1. Contact with the Competition Organizer on all matters related to it is possible via traditional mail at the address indicated in § 1 section 2 of the Regulations or at the following e-mail address: info@lorries.pl
  2. All content contained in advertising or promotional materials related to the Competition is for informational purposes only. Only the provisions of these Regulations and applicable laws have force. 
  3. Complaints regarding matters related to the Competition should be submitted in writing with justification to the Organizer to the addresses indicated in § 1 section. 2 of the Regulations within three days of the end of the Competition - in person or by registered mail (in this case, the date of the postmark determines whether the complaint will be considered). Complaints sent after the above deadline will not be considered. The organizer will consider complaints within 10 (ten) days from the date of their receipt, and will inform about their result in writing sent to the Competition participant at the address provided in the complaint. The Organizer's decision regarding the complaint is binding and final. 
  4. In justified cases, the organizers may change the Regulations in the form of annexes. 
  5. In matters not regulated by the Regulations, the relevant provisions of Polish law shall apply, in particular the provisions of the Civil Code and the Act on copyright and related rights. 
  6. Both the Competition Participants and the Organizer will strive to resolve any disputes arising under the Competition Regulations in an amicable manner, through negotiations.

  8. Any disputes regarding the Competition that cannot be resolved amicably will be resolved by a common court having jurisdiction over the Organizer's registered office.
